Important: Tumbly is a logbook for personal use. It is not medical advice and is not a substitute for care from a qualified pediatrician. Always consult a healthcare professional for questions about your baby's health.

1. Acceptance

By downloading, installing, or using Tumbly ("the App"), you agree to these Terms of Use. If you do not agree, do not use the App.

2. The service

Tumbly is an iPhone app that helps you log infant care activities (feedings, diapers, sleep, pumping, growth measurements, doctor visits) and review trends from those logs. It includes optional premium features ("Tumbly Pro") that may be unlocked via an in-app purchase through the Apple App Store.

3. Not medical advice

Tumbly does not provide medical, diagnostic, or therapeutic advice. The AI-generated summaries, insights, schedule predictions, and pediatrician brief are informational only. They are not endorsed by, and do not represent the opinion of, any healthcare professional. You agree not to rely on Tumbly to make clinical decisions about your baby. Always contact a qualified pediatrician or emergency services for medical concerns.

4. Your responsibilities

You agree to:

Use the App only for its intended personal infant-tracking purpose.
Provide accurate information when you log entries.
Be the parent, legal guardian, or authorized caregiver of any baby whose data you enter.
Comply with all applicable laws in your jurisdiction.
Not attempt to reverse engineer, modify, or extract source code from the App.
Not use the App to harm, harass, or impersonate another person.

5. Purchases and Tumbly Pro

Tumbly Pro is sold as a one-time non-consumable in-app purchase through the Apple App Store. Pricing, billing, refunds, and family sharing are governed by Apple's standard App Store terms. Tumbly does not process payments and does not store payment information. Purchases are tied to the Apple ID used to make them and can be restored on other devices using that same Apple ID via the "Restore Purchase" button.

6. Sharing with others

If you choose to share a baby with another person using CloudKit Sharing, that person will see the data you have logged for that baby. You are responsible for who you invite and what you share. You can revoke a share at any time from inside Tumbly.

7. Intellectual property

Tumbly, its name, design, code, and content are owned by the developer and are protected by copyright and other intellectual property laws. You receive a non-exclusive, revocable, non-transferable license to use the App for personal, non-commercial purposes.

8. Disclaimer of warranties

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including but not limited to fitness for a particular purpose, accuracy, completeness, and non-infringement. We do not guarantee that the App will be uninterrupted, error-free, or that any data loss will not occur. Always keep your own backups of important information.

9. Limitation of liability

To the maximum extent permitted by law, the developer of Tumbly shall not be liable for any indirect, incidental, consequential, special, or exemplary damages — including but not limited to loss of data, loss of profits, or harm to your baby's health resulting from reliance on the App — arising out of or in connection with your use of the App.

10. iCloud and third-party services

Tumbly depends on Apple services (iCloud, CloudKit, StoreKit, Apple Intelligence). Use of those services is governed by Apple's own terms. We are not responsible for outages, data loss, or behavior of these underlying services.

11. Termination

You may stop using the App at any time by deleting it from your device. We may discontinue or change features at any time without notice. These Terms remain in effect for any prior use of the App.

12. Changes to these terms

We may update these Terms from time to time. We will update the "Last updated" date at the top and, where appropriate, notify users in the App. Continued use after a change constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of the United States and the State of New York, without regard to its conflict of laws principles, unless a mandatory consumer-protection law in your jurisdiction provides otherwise.
